Yes, It’s Legal—But There Are Limits
Maryland has legalized medical cannabis for qualifying patients through its Medical Cannabis Program. However, legal doesn’t mean unrestricted. There are still rules and regulations you must follow to stay compliant—and avoid legal trouble.
As of July 1, 2023, adult-use recreational cannabis is also legal in Maryland, which has created additional clarity but also some confusion. Medical cannabis patients are still afforded certain additional protections and purchase limits compared to recreational users, but everyone must follow basic possession and transportation rules.
If You’re Pulled Over with Medical Cannabis
Being stopped by police while carrying cannabis can feel nerve-wracking, but if you’re following the rules, you are protected under Maryland law.
Here’s what to expect and how to handle the situation:
1. Stay Calm and Cooperative
Remain calm, be polite, and provide your driver’s license, registration, and insurance as requested. If asked whether you have cannabis in the car, you are not legally required to consent to a search—but being upfront can sometimes work in your favor if you are fully compliant with the law.
2. Keep Your Medical Card Accessible
Always carry your Maryland Medical Cannabis Commission (MMCC) card with you. If you’re transporting cannabis for medical use, this card is your best proof of legal authorization. You can also access your card digitally if needed.
3. Store It Properly
Cannabis should always be kept in its original packaging and ideally stored in the trunk or a sealed container away from the driver’s area of the vehicle. Never keep cannabis openly visible in your car or on your person while driving—it may raise concerns about impaired driving.
4. Don’t Drive Under the Influence
Even if you’re a medical cannabis patient, driving while impaired is still illegal and can result in DUI charges. Use responsibly and avoid consuming cannabis before or while operating a vehicle.
Can the Police Confiscate Your Medical Cannabis?
In most cases, no. If you’re a registered patient carrying your medication within the legal limits, law enforcement should not confiscate your cannabis. However, if you’re:
- Carrying more than the legal limit
- Suspected of driving under the influence
- Found with unapproved cannabis products
- Transporting it outside of Maryland
…you may be subject to legal penalties, confiscation, or further investigation.
Legal Possession Limits for Medical Patients
As a registered medical patient in Maryland, you can possess up to a 30-day supply, which is generally considered:
- 120 grams of usable cannabis (dried flower), or
- 36 grams of THC in cannabis-infused products (concentrates, edibles, etc.)
These limits may vary based on your provider’s recommendation, so check your current authorization through the MMCC portal if unsure.
Can You Travel with Medical Cannabis?
Only within Maryland.
Medical cannabis is still illegal under federal law, which means you cannot take it across state lines, even to another legal state. You also cannot bring it onto federal property, including:
- Federal parks
- Military bases
- Government buildings
